In the Texas NFA case, DOJ told a federal court that the injunction protects only the parties to the case, and Tennessee isn’t one of those states. So what protects Tennessee gun owners right now is ATF’s enforcement policy, not a court order or a law. Tennessee Gun Owners is asking Congress to make this relief permanent.

The suppressor win gun owners celebrated this month isn’t locked in. The Justice Department said as much in federal court on Monday, Oct. 12.
A win that rests on ATF’s word
In the Texas NFA case, DOJ told the court that ATF “will no longer enforce the challenged NFA provisions against anyone.” That sounds great, and it is good news. But DOJ also argued that the court’s injunction itself protects only the parties to the case, meaning the plaintiff states and their agencies, members and customers. Tennessee isn’t one of those states.
So what protects Tennessee gun owners right now is ATF’s enforcement policy, not a court order and not a law. A future administration could reverse a policy with the stroke of a pen. Machine guns and destructive devices are still under the NFA, and state law is unaffected either way.
Tell Congress to write it into law
A win that depends on whoever runs ATF isn’t a permanent win. I’m asking Congress to make this relief permanent in law so it can’t be quietly undone. Add your name today.

The General Assembly is adjourned until 2027, so this fight is in Washington right now, and that’s where your name needs to be.
P.S. Defending this win will take pressure, and pressure takes resources. If you can, chip in to help Tennessee Gun Owners keep it going. Chip in here.
